Impersonation : Kogi High Court Dismisses Anyebe`s Stay of Proceedings Motion

As the crisis in the Kogi People’s Democratic Party (PDP) enters a dramatic phase, the High Court sitting in Obangede, Kogi State, on Tuesday dismissed a motion to stay proceedings on the case of impersonation against Mr Enemona Anyebe.

Anyebe is one of the contenders to the chairmanship of the state chapter of the opposition party.

Recall, the court of Appeal in Abuja had held that the conduct of the Kogi State Congress of 31st August 2024 did not comply with the provisions of the PDP constitution 2017.

It also ruled that the congress did not meet the electoral guidelines issued on 1 May 2024 for the congresses, declaring it null and void and insisting that it should be set aside. The court therefore restrained him from parading himself as an elected official of the party.

In his argument, counsel to Capt. Joe Agada (one of the contenders) Bar. Onoja, urged the court to hold the motion on stay of proceedings as “vexatious, irritating and an affront to the Supreme Court decision that such an action constitutes an abuse of Court process and must be dismissed.”

While delivering judgment on the suit, Justice Adamu agreed with the position of the Supreme Court and dismissed the motion, declaring it “incompetent, unmeritorious and an abuse of Court process.”

This is as the court held that Barr. Kabiru had on December 9, 2024 at the Court of Appeal, Abuja, filed for a stay of proceedings on the matter.

The court further revealed that the same process was filed on the same issue on December 16, 2024, at the state High Court at Obangede, Barr. Sam Akoji. The case has been adjourned to May 19th for hearing.

Earlier, the Court had ordered for an election to the office of State Chairman of the party to be conducted on 18th February 2024 ahead of the expiration of the tenure of the former executives on 25 April, 2025.

Anyebe was also found guilty by the PDP`s disciplinary committees in his local government area and has since been debarred from holding party office.
