NERC Approves Plateau’s Regulatory Control Over Electricity

The Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of Plateau State’s electricity market to the Plateau State Electricity Regulatory Commission (PSERC).

In a statement released by NERC, the transfer aligns with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023. The law mandates states intending to regulate intrastate electricity markets to notify NERC and request a transfer of regulatory authority.

According to the Commission, the Plateau State government fulfilled all necessary legal requirements, leading to the approval of PSERC as the new regulatory body overseeing electricity operations within the state.

With this transfer, PSERC is now empowered to direct Jos Electricity Distribution Plc (JED) to establish a subsidiary—JED SubCo—which will handle intrastate electricity supply and distribution. NERC has given JED a 60-day deadline from March 12, 2025, to complete the incorporation of JED SubCo. The subsidiary must then apply for and obtain a license from PSERC to commence operations.

All necessary transfers under this directive are expected to be finalized by September 12, 2025.

Despite this transition, NERC will continue to serve as the central regulatory authority, overseeing inter-state and international electricity generation, transmission, supply, trading, and system operations.
