Supreme Court Overturns National Lottery Act

The Supreme Court on Friday, invalidated the National Lottery Act of 2005, a law passed by the National Assembly.

In a unanimous decision, a seven-judge panel ruled that the National Assembly did not have the constitutional authority to legislate on matters relating to lotteries and games of chance.

The Court determined that such legislative powers lie exclusively with the state Houses of Assembly.

Delivering the lead judgment, Justice Mohammed Idris stated that the National Lottery Act 2005 could no longer be enforced in any state, with the exception of the Federal Capital Territory, where the National Assembly has the power to enact laws.

This ruling stemmed from a legal challenge filed in 2008 by Lagos and several other states.
